Welcome to TCG Exchange ("TCGXC"). By accessing or using our website at https://www.tcgxc.com or our mobile application (collectively, the "Platform"), you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years of age to use TCGXC. By using the Platform, you represent that you meet this requirement and that all information you provide is accurate and complete. Users under 18 should have parental or guardian consent before using marketplace features.

2. Your Account

• ›You are responsible for maintaining the confidentiality of your account credentials.
• ›You are responsible for all activity that occurs under your account.
• ›You must notify us immediately at support@tcgxc.com if you suspect unauthorized access.
• ›You may not create accounts for others, share your account, or use another user's account.
• ›We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

When using TCGXC, you agree not to:

• ›Post false, misleading, or fraudulent listings or information.
• ›Manipulate card prices, artificially inflate or suppress values, or engage in wash trading.
• ›Harass, threaten, or abuse other users.
• ›Use the Platform for any unlawful purpose.
• ›Attempt to circumvent any security measures, rate limits, or access controls.
• ›Scrape, copy, or redistribute our price data or proprietary data without written permission.
• ›Use automated bots or scripts to interact with the Platform without written permission.
• ›Impersonate another user, vendor, or TCGXC staff.

4. Collection & Price Data

TCGXC provides card price data aggregated from third-party sources including eBay, Scryfall, pokemontcg.io, and YGOPRODeck. This data is provided for informational purposes only.

• ›Price data may not reflect current market conditions and should not be relied upon as financial advice.
• ›We make no guarantee as to the accuracy, completeness, or timeliness of any price data.
• ›TCGXC is not responsible for any losses resulting from reliance on our price data.
• ›Your collection data is yours — you can export it at any time via CSV.

5. Marketplace Rules

When buying or selling on the TCGXC marketplace:

• ›Sellers must accurately describe items and honor all listed prices. Cancelling an order without valid reason will result in a strike against your account.
• ›Buyers must complete purchases in good faith. False claims, chargebacks without basis, or failure to confirm receipt when items arrive will result in account action.
• ›Three strikes on either buyer or seller accounts may result in permanent suspension from marketplace features.
• ›All sellers must complete identity verification (KYC) before listing. This is required to maintain platform trust and comply with applicable laws.
• ›TCGXC charges a platform fee on completed sales. The fee is displayed clearly before you confirm a listing.
• ›Funds are held in escrow until the buyer confirms receipt. Disputes are handled by TCGXC founders who have final say on all resolutions.
• ›Listings found to be significantly outside market value may be flagged or removed at our discretion.

6. Card Show Finder

The Card Show Finder connects buyers and vendors at physical events. By checking in as a vendor, you agree to respond to buyer requests accurately and in good faith. Vendors who repeatedly confirm having cards they do not have, or fail to respond to requests, may lose access to vendor features. Buyers who request cards and fail to appear after a vendor confirms availability may receive strikes against their account.

7. Intellectual Property

All card images, names, and associated intellectual property belong to their respective owners (Nintendo/The Pokémon Company, Wizards of the Coast, Ravensburger, Konami, Bandai, etc.). TCGXC does not claim ownership of any card intellectual property.

The TCGXC platform, logo, design, software, and proprietary price data are owned by TCG Exchange and may not be copied, reproduced, or distributed without our written permission.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TCGXC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee uninterrupted access to the Platform and are not liable for any downtime, data loss, or service interruptions. Price data and market information are provided for informational purposes only and do not constitute financial, investment, or legal advice.

9. Limitation of Liability

To the maximum extent permitted by law, TCGXC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability to you for any claim arising from these Terms shall not exceed the fees you paid to TCGXC in the 90 days preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to TCGXC at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us at support@tcgxc.com. Upon termination, your right to use the Platform ceases immediately.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of TCGXC after changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.
